About the United States Constitution Essay Essay 1 The Constitution of the United States created the form of government known as federalism. The national and state governments each have specific powers and functions, while also sharing some of the same powers. The Constitution made the agreement that any laws passed under the constitution would be the supreme law of the land. Three separate branches were created; the legislative, executive, and judicial. **********The new Constitution resolved the weaknesses of the Articles of Confederation to the extent that it created a new system of government that was equipped with the necessary powers needed to implement changes through compromises, the passing of laws, and the levying of taxes. During the Constitutional Convention of 1787, delegates met in Philadelphia to discuss the difficult problems the new nation faced. The Framers decided that in order to facilitate change within the nation, the Articles of Confederation needed to be replaced with a new plan for government that would give the federal government more power to implement the changes necessary for the progression of the nation. The next step was to devise a plan for the government that would be accepted by the people of the nation. A series of compromises, known as the Three-Fifths Compromise, and the Great Compromise, were created. The Virginia Plan, created by James Madison, included an executive branch, courts, and a bicameral legislature where representation in each house of Congress would be based on each state’s population. This plan enticed delegates from heavily populated states such as, New York; however, the small states feared a government subjugated by the large states would give them no say. The New Jersey Plan, devised by delegates from the smaller states, included a unicameral legislature in which states would have equal representation. Within this plan, Congress had the power to set taxes and regulate trade, which were powers it did not have under the Articles of Confederation. The New Jersey Plan was not accepted because ******larger states thought they should have more power. After six rigorous weeks, *the delegates came to a compromise later known as the Great Compromise. The compromise proposed that Congress have two houses, a Senate and a House of Representatives, in which the Senate granted equal representation and the House granted representation based on population. In the Articles of Confederation, there was only *one vote per state. To pass laws, nine out of the thirteen colonies had to be in  favor of it and to make amendments; all thirteen colonies had to be in favor of the idea. The Great Compromise included that two thirds of the Senate and the House had to agree on a law or an amendment for it to be passed which was much easier. The compromise pleased both groups, but they were not completely satisfied. The Great Compromise directly dealt with the weaknesses within the Articles of Confederation and for this reason it gained popularity. The Three-Fifths Compromise came about after the Great Compromise which answered some of the remaining questions such as, who could vote. The compromise stated that every five enslaved persons counted for three free persons therefore, three-fifths of the slave population in each state would be used in determining representation in Congress. Americans were not all in favor of the Constitution at first, they were known as Anti-Federalists. They thought that the document would take away their liberties that Americans had fought hard to win from Great Britain. Their main argument was the new Constitution would create a strong, federal government and ignore the states and it lacked a bill of rights to protect individual freedoms. Those who were supporters of the document called themselves Federalists. They believed the Constitution would create a system of federalism, a form of government in which power is divided between the federal government and the states. The Federalist Papers, written by John Jay, Alexander Hamilton, and James Madison, was what won the Anti-Federalist’s support of the document. In a series of essays, they argued that the United States wouldn’t survive without a strong federal government and reassured the document would protect their nation. Both the Anti-Federalists and the Federalists came to the conclusion that if the Constitution was adopted, the new government would add a bill of rights. The Constitution was completely ratified in 1790 which made the thirteen independent states a united nation, The United States of America. The new Constitution created a framework for the government, which was the something the Articles of Confederation lacked. Three branches within the legislative were created to make sure the federal government would stay stable. Each branch had specific powers while also having the ability to check the powers of the other two branches. The legislative branch, also known as Congre ss, made the laws. The executive branch enforced the laws and is headed by a president and vice president. The judicial system was created in which the  supreme court of the U.S would have the final say as to the constitutionality of laws. In order to avoid one of the branches from gaining too much power, the Framers included a system of checks and balances. This system allowed each branch of government to limit the power of the others. Therefore, the new Constitution resolved the weaknesses of the articles of confederation to the extent that it created a new system of government that was equipped with the necessary powers needed to implement changes through compromises, the passing of laws, and the levying of taxes. The government was able to tax and secure individual freedoms. The thirteen independent states became one nation, The United States of America. Although, not all of the problems of the Articles of Confederation were resolved, the new Constitution created a foundation for our government today.

Hawthorne Writing Style Nathaniel Hawthorne was a prominent early American Author who contributed greatly to the evolution of modern American literature. A New England native, Hawthorne was born in Salem, Massachusetts on July 4, 1804 and died on May 19, 1864 in New Hampshire. An avid seaman, Hawthorne^s father died in 1808 when Nathaniel Hawthorne was only a young child. After his father^s death, Hawthorne showed a keen interest in his father^s worldwide nautical adventures and often read the logbooks his father had compiled from sailing abroad. Hawthorne was a descendant of a long line of New England Puritans, which sparked his interest in the Puritan way of life. After he graduated from Bowdoin College in 1825, Hawthorne returned to his home in Salem were he began to write in semi-seclusion. Hawthorne published his first novel, Fanshawe in 1828. In 1839, Hawthorne was appointed weigher and gauger at the Boston Custom House. He later married Sophia Amelia Peabody in 1842. In the following years, Hawthorne wrote his more famous novels which shaped his own literary style, as well as the genres of the romance novel and short story. Eventually, Hawthorne developed a style of romance fiction representative of his own beliefs. Although Nathaniel Hawthorne^s writing style was often viewed as outdated when compared to modern literature, Hawthorne conveyed modern themes of psychology and human nature through his crafty use of allegory and symbolism. To begin with, Hawthorne^s style was commonplace for a writer of the nineteenth century. During the time period in which Hawthorne wrote, printing technology was not yet advanced enough to easily reproduce photographs in books. Therefore, Hawthorne frequently wrote lengthy visual descriptions since his audience had no other means to see the setting of the novel. (Magill:1 840). One example of such descriptions was in The Scarlet Letter when Hawthorne intricately describes the prison door and its surroundings. Another aspect of Hawthorne^s writing which was exclusive to his time period was the use of formal dialogue which remained fairly consistent from character to character (Magill:2 140). Such overblown dialogue was evident in The Scarlet Letter when the dialogue of Pearl, a young child, exhibited no difference from the dialogue of the other characters in the novel. Hawthorne adopted the use of overly formal dialogue partly from a British writer, Sir Walter Scott, whose works were popular in the United States and Great Britain (Magill:1 841). Although Hawthorne^s dialogue was overly formal, it was an accurate tool in describing human emotion (Gale). Absence of character confrontation was another component of Hawthorne^s literary style.

Marriage for money and convenience, as well as familial preservation, formally dominated matchmaking choices. Love and romance were but luxuries in the business-like fashion of marriage. Austen contested this reality and criticized it, but she also placed one thing above romance: the Self. Austen undoubtedly prizes respect for the Self above social expectation and relationships. Handler and Segal (45) noted that themes of â€Å"independence, dependence, and choice† are recurring throughout all of Austen’s works. Recent film adaptations to Austen have decided to downplay these themes, however, in exchange for playing up the romance. These films reveal the 20th century emphasis on romance at the cost of excluding the already estab lished importance of self-knowledge. Pride and Prejudice, Austen’s first written but later published novel, is a commentary on the importance in society of inheritance and achievement. Austen obviously valued one’s achieved virtues over inherited status, a revolutionary notion for a female of the day. Elizabeth Bennet, Austen’s own mouthpiece to criticize her times, bridges the gap between 19th century sensibility and 20th century self-exploration. Lizzy, though given the opportunity on more than one occasion (Mr. Darcy’s first and Mr. Collins’s only proposal) to save herself from her impending poverty as well as preserve her family’s estate, choose rather to be alone than to be in a situation that would compromise her principles. She is a woman of a strong-willed character who puts herself above her society’s expectations of her. If Elizabeth’s parents had known of her initial refusal of Darcy their disbelief would have probably outweighed her reasons for rejectin g him. Even Mr. Bennet, though a staunch supporter of Elizabeth, may not have felt that she had acted prudently considering the family’s situation. This was before her sister Jane was engaged to the wealthy Mr. Bingley, and concern over the future entailment of the estate to Mr. Collins was still great. She didn’t even consider Darcy until her began exhibiting signs that he respected her, such as his ... ...rement for well-rounded development, and as it has become more common, its importance has been taken for granted. How Austen would deal with this present reality is unsure but likely with some disdain. Austen did not preach revolution and women’s’ rights, she only presented her world as she saw how it was and how it should be. Now that the Self has now been placed on the back burner for romantic interests or has been ballooned to the point of excess is only a creation of the present, a true novelty in human history. Jack Daniel's Case Analysis I. Identify Symptoms 1. Jack daniel traditionally gave the slop for free for decades, then established a price of $2 per thousand gallons, and then raised to $4. Because of the low prices and availability of the feed, farmers began to expand their business. Water was being polluted by the excess amount of cattle being raised. 2. Jack Daniel informed farmers it would stop delivery until proper environmental improvements are made. However, there was no formal written contract stating Jack Daniel will continue delivering the slop. . A low demand of whisky occurred, because consumers turned to lighter beverages. This resulted in Jack Daniel’s â€Å"dry house† method which disposes of thick slop.4. Layoffs were made in Jack Daniel. 5. Angry employees may form a union 6. Farmers were angry, having no slop to feed their cattle. 7. The farmers moved the feedlots and improved the environmental conditions. Farmers state that Jack Daniel promised them s lop if they fixed the water pollution problem. 8. Jack Daniel denies making such promise. II. Root Cause . There is no written contract between the farmers and Jack Daniel stating the terms and commitments they have for each other, such as, Jack Daniel providing the thick slop for the farmers for affordable prices, and the farmers preserving the environment. III. Stating the issue 1. What actions should be implemented in order to meet each side’s needs, while keeping both Jack Daniel and the farmers’ businesses afloat? IV. Alternatives 1. Jack Daniel could return to selling its traditional whiskey with thick slop.In doing so, it could raise the price of thick slop to the farmers to cover the expenses it takes to make it. Positive: The farmers can feed the cattle. Negative: a. The feed will not be at a bargain price which will lead to farmers looking for alternatives. This result to more tension between the farmers and Jack Daniel. b. Jack Daniel will only be wasting it s time and money in making the whiskey because demand for it has dropped. . The farmers should find an alternative feed for the cattle. Positive: a. Jack Daniel will continue to make its dry house method with no thick slop and keep its business afloat. b. The tension between the tow might break. Negative: a. Farmers will have to seek alternative means of feeding the cattle and may have to down size its recent growth. b. Tension might only increase. 1.Jack Daniel could hold to its promise that it would stop delivery unless the farmers made environmental improvements, which the farmers invested heavily on doing so. Positive: a. Tension will clear between the two. b. The farmers will have their feed. Negative: a. No written contract made. Jack daniel is not obligated to support the farmers. The free ride never lasts forever. V. Best Alternative There was no formal contract between the two. JD and the farmers should sign an ethical and legal contract stating their terms if any.But again JD is not obligated to do anything. VI Recommended action and follow up If the farmers like to take legal action, it will only trigger more tension and go no where in court because there is no written claim to back them with. JD might be seen as unethical on breaking their promise but there was no proof that they had a promise and they have been doing a favor to the farmers up until now. If the farmers find no other alternative to feed cattle, they should form a business proposal for JD that fit their needs while keeping their own business afloat.
